01 Privacy Policy

1.2 Data We Collect. In the course of providing our digital agency services, MomentumCoreLabs may collect and process the following categories of personal data:

1.3 Purpose of Processing. Your personal data is processed for the following lawful purposes under the EU General Data Protection Regulation (GDPR):

  • To respond to your inquiries and provide the digital services you have requested (Performance of a contract — Article 6(1)(b) GDPR).
  • To manage our ongoing business relationship, including service delivery, invoicing, and project communication.
  • To comply with legal obligations applicable to our business operations in the European Union.
  • To maintain the security and integrity of our website and digital infrastructure (Legitimate interest — Article 6(1)(f) GDPR).

1.4 Data Retention. MomentumCoreLabs retains personal data only for as long as necessary to fulfill the purposes for which it was collected. Contact form submissions are retained for a maximum of 24 months. Data related to active service contracts is retained for the duration of the contract plus 6 years in compliance with Spanish commercial record-keeping obligations.

1.5 Data Sharing. We do not sell, rent, or trade your personal data. Data may be shared with the following categories of recipients only when strictly necessary:

  • Technology service providers (hosting, email delivery) who process data under written data processing agreements in compliance with Article 28 GDPR.
  • Public authorities when required by law, regulation, or judicial order.
  • Professional advisors (legal, accounting) bound by professional confidentiality obligations.

1.6 International Transfers. MomentumCoreLabs does not transfer personal data outside the European Economic Area (EEA) unless adequate safeguards are in place, including Standard Contractual Clauses (SCCs) approved by the European Commission, in accordance with Article 46 GDPR.

1.7 Your Rights. Under the GDPR, you have the following rights regarding your personal data:

02 Cookies Policy

2.1 What Are Cookies. Cookies are small text files placed on your device when you visit a website. They are widely used to enable website functionality, improve user experience, and provide analytical information to website operators.

2.2 Cookies We Use. MomentumCoreLabs uses only strictly necessary cookies essential for the operation of this website. We do not deploy analytics cookies, advertising cookies, or any third-party tracking cookies. The cookies in use are:

  • Cookie Consent Status: A single localStorage entry (mcl_cookie_accepted) that records whether you have acknowledged our cookie notice. This does not collect or transmit any personal data. It is stored locally on your device and is never sent to any external server.

2.3 Third-Party Cookies. This website does not set any third-party cookies. Embedded content (such as Google Maps on our contact page) may set cookies according to Google's own privacy policy when you interact with the embedded frame. MomentumCoreLabs has no control over these third-party cookies.

2.4 Managing Cookies. You can manage or delete cookies through your browser settings at any time. 03 Refund Policy

3.1 Scope. This Refund Policy applies to all digital services provided by MomentumCoreLabs, headquartered at C. Gutemberg 43, Badajoz, Badajoz, Espana. It governs the conditions under which refunds may be issued for services rendered or payments processed.

3.2 Pre-Service Cancellation. If you wish to cancel a service engagement before work has commenced, you are entitled to a full refund of any advance payment within 14 business days of the cancellation request, provided the cancellation is received in writing at [email protected] before the project kickoff date specified in the service agreement.

3.3 Partial Completion. In the event that a service engagement is terminated after work has commenced, MomentumCoreLabs will issue a prorated refund based on the percentage of the project completed at the time of termination. The assessment of completed work milestones will be documented and communicated to the client within 5 business days of the termination request.

3.4 Post-Delivery Refunds. Once a digital deliverable (website, design asset, campaign configuration, or similar) has been delivered and accepted by the client, refunds are not available for the completed portion of the work. MomentumCoreLabs offers a 30-day revision period following delivery during which reasonable modifications within the original project scope will be implemented at no additional cost.

3.5 Non-Refundable Items. The following are not eligible for refunds:

  • Third-party costs incurred on behalf of the client (domain registrations, hosting fees, software licenses, stock assets) that have already been paid to the respective provider.
  • Consulting or advisory sessions that have been fully delivered.
  • Services rendered under a custom agreement with specific refund terms that override this general policy.

3.6 Refund Processing. Approved refunds will be processed using the original payment method within 10 business days of approval. If the original payment method is no longer available, an alternative method will be arranged in consultation with the client.

3.7 Dispute Resolution. In the event of a disagreement regarding refund eligibility, both parties agree to attempt resolution through direct communication before pursuing formal dispute mechanisms. MomentumCoreLabs is committed to fair and transparent resolution in accordance with applicable Spanish consumer protection regulations.

04 Terms of Service

4.1 Acceptance. By accessing and using the website and services of MomentumCoreLabs (C. Gutemberg 43, Badajoz, Badajoz, Espana), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services or access this website.

4.2 Services. MomentumCoreLabs provides digital agency services including but not limited to brand strategy, web development, UI/UX design, copywriting, SEO optimization, e-commerce integration, cloud infrastructure deployment, and data analytics. The specific scope, deliverables, timeline, and pricing for each engagement are defined in a separate service agreement or proposal accepted by the client.

4.3 Intellectual Property. Upon full payment of all outstanding invoices, the client receives full ownership of all custom-designed deliverables produced specifically for that engagement, including final design files, source code, written content, and brand assets. MomentumCoreLabs retains the right to display completed work in its portfolio and marketing materials unless explicitly prohibited in writing by the client. Pre-existing frameworks, tools, libraries, and methodologies used in the delivery process remain the property of MomentumCoreLabs.

4.4 Payment Terms. Unless otherwise specified in the service agreement:

  • Invoices are payable within 14 days of issuance.
  • For projects exceeding 2,000€, MomentumCoreLabs may require a 40% advance payment before commencing work, with the balance due upon delivery.
  • Late payments incur a statutory interest rate of 4% per annum plus a fixed recovery fee of 40€ as permitted under EU Directive 2011/7/EU on late payments in commercial transactions.
  • MomentumCoreLabs reserves the right to suspend all active services if payment remains outstanding for more than 30 days past the due date.

4.5 Confidentiality. Both parties agree to maintain the confidentiality of proprietary information exchanged during the course of the engagement. This includes business strategies, technical specifications, client data, pricing structures, and any information marked as confidential. This obligation survives the termination of the service agreement for a period of 24 months.

4.6 Limitation of Liability. MomentumCoreLabs shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total aggregate liability for any engagement shall not exceed the total fees paid by the client for that specific engagement. We are not responsible for delays or failures caused by force majeure events, third-party service providers, or client-side actions.

4.7 Termination. Either party may terminate a service agreement with 14 days' written notice. In the event of termination, the client is responsible for payment of all work completed up to the termination date. MomentumCoreLabs will deliver all completed work-in-progress within 7 business days of receiving a termination notice.

4.8 Governing Law. These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Spain. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Badajoz, Badajoz, Espana.

4.9 Amendments. MomentumCoreLabs reserves the right to amend these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
